Philippines: NTC Open Public Hearing for Performance Standards for Data Transmission

On February 2, 2026, the National Telecommunications Commission (NTC) issued Memorandum Circular No. 002-02-2026. The Memorandum Circular establishes mandatory performance standards for Data Transmission Industry Participants (DTIPs) pursuant to Republic Act No. 12234 (the Konektadong Pinoy Act) and its Implementing Rules and Regulations (IRR).

The purpose of these Performance Standards for Data Transmission is to ensure high-quality data service transmission, align Philippine network performance standards with regional and international benchmarks, and define Quality of Service (QoS) parameters measured across network segments.

Furthermore, the Performance Standards for Data Transmission provide a framework for monitoring, compliance, and enforcement. In this regard, the NTC opened a public hearing for all relevant stakeholders.

What is Stipulated?

Memorandum Circular No. 002-02-2026 establishes minimum performance standards for downstream (last mile) and upstream (international gateway, core/backbone, and middle mile) network segments. We will explain the minimum thresholds for each parameter in more detail in the next section.

This Circular will take effect fifteen (15) days after its publication in the Official Gazette or a public newspaper and registration with the National Administrative Registration Office (ONAR).

Furthermore, DTIPs are required to comply with these standards within six months of publication. The NTC must be notified of the Ready-to-Operate (RFS) date, scheduled downtime at least 14 days in advance, and significant disruptions within two 24-hour periods.

DTIPs must also maintain documentation demonstrating compliance for audit and inspection purposes. The NTC will monitor compliance quarterly, publish performance results, conduct audits and inspections, engage independent monitoring entities when necessary, and request additional reporting for specific regions or emergencies.

Performance Standards for Data Transmission Services

Last Mile (Downstream)

The following Quality of Service (QoS) parameters, with corresponding minimum thresholds, shall govern the performance of data transmission services at the last-mile segment:

The following Quality of Service (QoS) parameters, with corresponding standards and minimum thresholds, are hereby adopted to govern the performance of data transmission services at the International Gateway Facility, Core or Backbone, and Middle Mile segment:

Open Public Hearing

The public hearing about Performance Standards for Data Transmission will be held on Monday, March 2, 2026, at 2:00 PM. The location is at 5/F NTC Multi-Purpose Hall, NTC Building, Senator Miriam Defensor Santiago Avenue, East Triangle, Diliman, Quezon City.

The public hearing will be attended by relevant stakeholders invited by the NTC. Parties may submit their respective position papers on or before 23 February 2026. Hard copies of the position papers shall be submitted to the Office of the Commissioner, attention to the Legal Branch.

Soft copies thereof, both in Microsoft Word and PDF format, shall be submitted via email to commissioner@ntc.gov.ph, with the subject header “Position Paper on the Performance Standards for Data Transmission Industry Participants (DITPs) Pursuant to RA12234 or the konektadong Pinoy Act.”

Impact on the Philippines Type Approval

Performance Standards for Data Transmission will certainly have an impact on the Philippines Type Approval. This means that six months after the regulation is enacted, all related certification applications will be subject to the new parameters.

If non-compliance is found, the NTC can request corrections within a reasonable timeframe and impose administrative sanctions in accordance with the IRR.
