Applicant for Indonesia DJID Certification Regulation

PERMEN No. 3 Tahun 2024 which explains the application for Indonesia DJID certification is explained in CHAPTER III on the Issuance of Telecommunication Equipment and/or Telecommunication Device Certificates, precisely in articles 10 and 11:
Article 10
1. The certificate as intended in Article 7 paragraph (1) is submitted by an applicant who is:
a. Business Actors who:
- Is a registered trademark holder in Indonesia.
- Is appointed as a representative and/or distributor of the brand holder.
- Manufacture and/or assemble Telecommunications tools and/or telecommunications devices for brand holders.
- Manufacture and/or assemble Telecommunications tools and/or telecommunications devices; or
- Use telecommunications tools and/or telecommunications devices for their purposes.
b. State Administrative Agencies.
c. International organizations; or
d. Individual person.
2. Applications for Certificates by State Organizing Agencies, international organizations, or individuals as intended in paragraph (1) letters b, c, and d can only be submitted for Telecommunications tools and/or telecommunications devices used for their purposes.
Article 11
- Applications for Certificates by Business Actors as intended in Article 10 paragraph (1) letter a are submitted through the OSS System which is integrated with the Directorate General’s Certification Service Facility.
- Applications for Certificates by State Administrative Agencies, international organizations, or individuals as intended in Article 10 paragraph (1) letters b, c, and d are submitted to the Minister through the Directorate General’s Certification Services Facility.
- Application for Certificate as intended in paragraph (1) implemented under the provisions of laws and regulations regarding the OSS System for the implementation of risk-based business licensing.
Things That Need to be Considered by Applicant for Indonesia DJID Certification

In addition to what has been written in PERMEN No. 3 Year 2024, there are several things that applicant for Indonesia DJID certification need to know. The first thing to ensure is that the local company (applicant) is not a brand holder.
Then to validate that the certificate holder/applicant is really an authorized partner responsible for the sale and/or use of the product in Indonesia, the DJID certification also requires to submission of a copy of the distribution agreement or MoU between the certificate holder and the brand holder.
For a distribution agreement or MoU to be accepted to apply for a DJID certificate, make sure you meet the following requirements:
- The agreement must be in the form of an MoU, not in the form of a Power of Attorney or power of attorney certificate.
- The purpose of the MoU must include a cooperation clause between the distributor and the brand holder. The MoU should not be if it is only for certification.
- There must be a clause stating that the brand owner (first party) authorizes the distributor or representative (second party) to be responsible for the warranty, sale, and/or use of the product in Indonesia.
- Must follow the legal jurisdiction of one of the parties.
