Vietnam MOST Issued 012025TT-BKHCN New Regulations of License Exemptions for Radio Equipment

Vietnam MOST (The Ministry of Science and Technology) issued the updates of license exemptions and technical requirements for certain types of radio equipment with Circular No. 01/2025/TT-BKHCN. The update was published on March 31, 2025.

The new update that Vietnam MOST discharged concerns approximately the list of radio frequencies utilizing license-exempt radio devices and going with specialized and operational conditions.

Vietnam MOST new circular revises multiple sections of Circular No. 08/2021/TT-BTTTT, which specifies the list of radio devices that do not require individual frequency licenses, along with the conditions for their use.

This circular specifically modifies Appendices 2, 10, and 16 of the 2021 regulation, which list:

1. Amendments and supplements to Appendix 2

  • Modification of Item 8, Clause 1: The frequency range 315–400 kHz is now designated for wireless power transfer devices, with updated requirements for primary and spurious emissions.
  • New Item 54a (added after Item 54, Clause 1): The 5925–6425 MHz band is introduced for Wireless Local Area Network (WLAN/RLAN) devices, incorporating new technical standards for emissions (Spurious Emission Limit 25 and Unwanted Emission Limit 3).
  • Removal of Item 9, Clause 1.
  • New Definitions Added (Points 2.25 and 2.26, following Point 2.24 of Clause 2): Introduces technical specifications for Spurious Emission Limit 25 and Unwanted Emission Limit 3, including power output, frequency range, bandwidth, and compliance with ETSI EN 303 687 V1.1.1.

2. Amendment and supplementation to Appendix 10

The 5925–6425 MHz frequency band is allocated for WLAN/RLAN devices under these conditions:

  • Varying emission limits apply depending on bandwidth (≤ 200 mW, ≤ 25 mW, ≤ 10 dBm/MHz).
  • Devices must meet Spurious Emission Limit 25.
  • Certain emission levels are limited to indoor or electromagnetically shielded environments.
  • Unmanned aircraft systems (UAS/Drones) are prohibited from using this band.
  • The 5925–5945 MHz portion is reserved as a protection band.
  • Users and operators must comply with regulations on telecommunications, cybersecurity, and data privacy.

3. Amendment to Appendix 16

The previous allocations of 326.5 kHz, 340 kHz, and 353–373.5 kHz for wireless power transfer devices are replaced with the 315–400 kHz band.

New usage conditions include:

  • Devices must use inductive loop technology.
  • Installation is restricted to non-outdoor, non-fixed locations without fixed outdoor antennas.
  • These devices are prohibited on aircraft.

The amendments are grounded in Vietnam’s evolving National Radio Frequency Spectrum Planning, as defined by several decisions from the Prime Minister and prior regulations.

The new changes of Vietnam MOST new regulations will take effect on May 15, 2025. The updates reflect Vietnam’s effort to maintain efficient spectrum use and ensure equipment continues to meet national standards.
