Philippines: Amending Memorandum Circular No. 03-05-2007

On 15 Mei 2026, the National Telecommunication Commission (NTC) of the Philippines is amending Memorandum Circular No. 03-05-2007. This regulation is particularly on the allocation of the 77–81 GHz frequency band.

This memorandum circular is for equipment designed to detect movement and provide alerts, including low-power radar systems intended for radiodetermination purposes. The Background of Amending 

The NTC’s amendment to Section 2 of Memorandum Circular No. 03-05-2007 is intended to serve the public interest and keep pace with developments in wireless technology. The Authority seeks to ensure broader access to the limited radio spectrum and the cost-effective use of technology.

This is based on Act No. 3846, as amended (Radio Control Act), Republic Act No. 7925 (Philippine Public Telecommunications Policy Act), and Executive Order No. 546 of 1979.

Operating Parameters of Memorandum Circular No. 03-05-2007

Memorandum Circular No. 03-05-2007 has operating parameters that need to be fulfilled in the testing. The limits of the technical parameters herein prescribed shall not be exceeded by any function of the equipment or by any means.

Any circular, memorandum, order, or parts thereof inconsistent with the provisions of this Circular shall be deemed amended or superseded accordingly.

Public Consultation

Regarding the Memorandum Circular No. 03-05-2007, stakeholders are invited to submit their suggestions. Input and comments on the new regulation NTC announcement are open until 26 May, 2026. 

The manufacturer, importer, or distributor should send the hard copies of the position papers to the Officer of the Commissioner, attention to the Radio Spectrum and Planning Division. Soft copies must be submitted in Microsoft Word and PDF format via email to [email protected] and [email protected].

The email must include the subject header “Position Paper on Amending Section 2 of NTC Memorandum Circular No. 03-05-2007.” The parties should also indicate their personal/company information, including address, contact number, and email address, on the cover page/email of the submission.

NTC is also arranging a Public Hearing on the proposed Memorandum Circular to be held on 02 June 2026, Thursday, at the 5/F NTC Multi-Purpose Hall, NTC Building, Senator Miriam Defensor Santiago Avenue, East Triangle, Diliman, Quezon City.

The Impact of the Philippines Type Approval 

The Memorandum Circular No. 03-05-2007 will certainly have an impact on the Philippines type approval process. The allocation of the 77–81 GHz frequency band for Equipment for Detecting Movement and Alert must comply with the new standard. 

This Circular shall take effect 15 days following its publication in a newspaper of general circulation and its filing with the Office of the National Administrative Register (ONAR) of the University of the Philippines Law Center. 

The technical parameters will serve as the new limit. Therefore, manufacturers, importers, or distributors must begin reviewing their equipment to gradually align with the planned standards.
