Nigeria Strengthens Type Approval for SIM-Enabled Devices

The Nigerian Communications Commission (NCC) announced a new framework to strengthen compliance with Type Approval requirements for SIM-enabled devices.

This new framework is supported by the Device Management System (DMS) as a tool for automated device monitoring and verification. This will help authorities improve compliance with technical and regulatory requirements for telecommunications equipment.

Type approval has long been a mandatory requirement for telecommunications equipment seeking to enter the Nigerian market. However, this new framework provides a more structured mechanism for monitoring compliance and verifying devices before they can be marketed and used.

Background on Type Approval Requirements in Nigeria

Type approval in Nigeria is governed by Section 132(2) of the Nigerian Communications Act of 2003. The law mandates type approval as a fundamental requirement for communications equipment. Therefore, manufacturers and suppliers must obtain NCC Type Approval before their telecommunications products can be sold or used in Nigeria.

The implementation of type approval in Nigeria is supported by the Type Approval Business Rules issued in August 2024. These rules establish a regulatory framework for enhanced monitoring and compliance verification, including the implementation of the Central Equipment Identity Register (CEIR).

Introduction of the Device Management System

The Device Management System (DMS) is a technology recently introduced by the NCC as the foundation for supporting Nigeria’s new automated compliance framework. Through this platform, SIM-enabled communication devices will be electronically checked to verify whether they meet NCC type approval requirements.

With the DMS, authorities can enhance oversight of the national device ecosystem while making compliance monitoring more efficient, consistent, and effective. Furthermore, this system supports broader market surveillance efforts so that devices that do not meet applicable regulatory standards can be identified.

A key component of the framework is the Central Equipment Identity Register (CEIR), which serves as a centralized database for SIM-enabled communication devices operating in Nigeria.

This registry records device identification information, including the International Mobile Equipment Identity (IMEI) number. This centralized registration of IMEI numbers will enhance the ability to verify type approval requirements and ensure that telecommunications devices meet applicable standards.

SIM-Enabled Devices Must Be Registered Before Sale

For SIM-enabled communication devices, compliance obligations do not end after obtaining Type Approval certification. Under the new framework, SIM-enabled devices must be registered through the DMS before they can be placed on the Nigerian market.

This is an additional layer of compliance that complements the existing type approval framework. Devices entering the Nigerian market must be properly identified and registered in the regulatory system. Devices that are not properly registered will not be permitted to operate on Nigerian telecommunications networks.

To verify this, device identity information must be verified through IMEI registration. This allows the NCC to authenticate individual devices and improve traceability across the supply chain.

Implementation of the First Phase Has Begun

The NCC’s announcement regarding this new automated compliance framework marks the implementation of its first phase. This initial phase focuses on onboarding existing device inventories and ensuring that newly imported devices are properly registered and authenticated. Additionally, newly imported devices must also be properly registered and verified before they can be sold and used in Nigeria.

Throughout the implementation process, the NCC is collaborating with various stakeholders, including the Nigerian Customs Service, Original Equipment Manufacturers (OEMs), importers, and relevant industry associations.

Existing Inventory Must Be Reviewed

In this first phase, distributors, dealers, and retailers need to focus on the devices already in their inventory. They must ensure that these devices meet the applicable Type Approval and device verification requirements.

Companies should work with their suppliers to resolve any outstanding compliance issues before distributing or placing such products on the Nigerian market.

Expected Benefits

The implementation of the new framework is not only intended to strengthen the enforcement of type approval in Nigeria but also represents the NCC’s effort to provide broader consumer protection.

The Device Management System (DMS) is expected to serve multiple purposes—from helping to improve compliance and strengthen oversight to boosting consumer confidence in telecommunications products sold in Nigeria.

Through this system, illegally imported devices can be identified. As a result, the Authority can improve its handling of non-compliant products. Additionally, devices reported as lost or stolen can be more easily identified and blocked from operating on Nigerian cellular networks.

Privacy Considerations

Device registration and IMEI management are not without privacy concerns. This is because the DMS stores device identification information, including IMEI numbers.

In this regard, the NCC explains that the DMS is designed solely to support device identification and compliance with type approval. The NCC does not grant access to content stored on users’ devices and does not use it to monitor private communications.

What This Means for Manufacturers and Importers

This new framework has a direct impact on manufacturers, importers, and distributors. They need to review SIM-enabled communication devices to ensure their compliance procedures are in order.

Companies must ensure that device registration and identification requirements are properly fulfilled before entering the market. They should also review devices already held in inventory and ensure that applicable Type Approval and device verification requirements have been fulfilled.
